RE: Men and Women corruptly being sent to prison
I am writing to ask your assistance with a situation that has affected me and many others in Georgia. It is blatant disregard, as well as a criminal disregard of both State and Federal constitutions as well as many articles…
Nationwide, the numbers are staggering: Nearly 2.4 million people behind bars, even though over the last 20 years the crime rate has actually dropped by more than 40 percent.
“The United States has about 5 percent of the world’s population, but we have 25 percent of the world’s prisoners - we…
MEDIA REPORT: CASE NOTE
March 14th 2012
The Sydney Morning Herald
Title: “When it comes to crime, harsher punishment doesn’t pay”
FACTS:
- Bureau of Crime Statistics and Research (BOCSAR) has found that increasing risk of arrest and imporisonment are far more effective methods of preventing crime rather than lengthening prison sentences
- The director of BOCSAR has suggested that the government should focus more in strategies to increase the risk of arrest and less on increasing the severity of punishments and imprisonment
- Dr Weatherburn also suggested that the long term solution to prevent crime is a strong economy not tough penalties or rehabilitation
- He also suggested reducing poverty and tackling income inequality in order to reduce crime
Legal question/ issue of law reform: should the government introduce new, costly reform in order to respond to such statistics?
Relation to syllabus:
- CRIME – criminal justice issues – sentencing
- “The main aims of the criminal justice system are to punish and prevent crime. Sentencing, along with other elements of the criminal justice system such as policing practices and crime prevention strategies all play a part in achieving these aims. Sentencing occurs only when an offender has been found guilty and convicted of an offence.” – LIAC sentencing section
In an exam: I would discuss this media report and the statistics it outlines in relation to sentencing and the effectiveness of prison sentences
Opinion:
In my opinion I think that the suggestions made by Mr Weatherburn should be slowly implemented to see if any changes occur in the levels of criminal activity even though they may cost the government money, the benefits they would have on society and long term economic benefits outweigh the cost
